"ADVENT CALENDAR DRAW"

1. ORGANIZER
Panapop Enterprises S.L., headquartered in La Marina de València, Muelle de la Aduana s/n, Edificio Lanzadera, 46024 Valencia, SPAIN, organises an ADVENT CALENDAR PRIZE DRAW (the draw) on the dates advertised below, which is free to enter and implies no obligation of purchase whatsoever on the part of the participants. The draw will be in accordance with the following clauses.

2. GENERAL TERMS

From the 1st of December to the 3rd of January (both included), a lot will be drawn every two to three days for the chance to win a product from our catalogue or those of our partner brands. 

To participate, users must follow @panapopbrand on Instagram and publish a comment on the relevant Instagram post announcing the draw. There will be a closing data and time associated with each draw, which will be clearly advertised. 

To be eligible, participants must: 

• Be over 18 years of age

• Reside in Spain

• Follow @panapopbrand on Instagram

• Comply with the prerequisites for the draw in question


3. PRIZE

Lots will be drawn for the prize of 1 product from our catalogue as advertised in the draw.

Conditions: the winner must claim their prize within 15 days of being notified of the results.

Draw prizes are non-transferable and cannot be exchanged for money. In the event that one of the products won through the draw is out-of-stock, it may be redeemed for a product in the same category and of similar value.


4. DELIVERY OF THE PRIZE

The winner will be contacted by Panapop by direct message on Instagram. Once the prize is accepted, the winner will receive an email explaining how to arrange the delivery. 

By accepting the prize, the winner authorises Panapop to publish the winner’s full name and image on their website and social media, without this giving the winner the right to receive compensation for the use of their data. If the winner refuses to accept the prize for whatever reason, or fails to claim it within the allotted time, Panapop is under no obligation to allocate the prize to another person.

5. DATA PROTECTION

By participating in the draw and submitting their personal data, participants authorise Panapop to handle the data submitted. Panapop then becomes responsible for the safe handling of this data, and will use it to manage the promotional draw, to contact the winner, send them their prize, and to send them promotional information subsequently. 

Panapop will handle participants’ personal data in accordance with the Privacy Policy, which is compliance with the European Union’s GDPR and the Spanish State’s LOPD. Participants, in turn, guarantee that the personal data provided is true, complete, accurate and up to date. The data subjects may exercise their rights of access, rectification and erasure by sending an email at hello@panapop.com with their request, along with a scanned copy of their passport or other valid ID document.


6. MISCONDUCT 

Panapop reserves the right to adopt whatever measures they deem necessary to prevent misconduct, or actions that are perceived by Panapop to have the intent or effect of committing fraud or of violating the rules of this draw, or of causing harm to other participants. The first measure taken by Panapop in these cases, with immediate effect, will be the exclusion of the participant in question from the draw, and the loss of the right to any eventual wins.

Panapop also reserves the right to exclude participants from the draw if it considers that this is appropriate. In particular, Panapop reserves the right to exclude entries containing explicit sexual content or pornography.


7. EXEMPTIONS FROM GUARANTEES AND RESPONSIBILITY 

Panapop cannot be held responsible for failures of, or interruptions to, website or Internet access, failures of electronic communications networks, software or hardware, or for potential errors in the submission or processing of draw entries or personal data, or failures in the delivery of prizes. If any such failures do occur, Panapop will do whatever they can to remedy them as soon as possible, but they cannot accept any responsibility whatsoever. 

Panapop cannot take responsibility for any damage caused by misuse of the website content or services that may occur in spite of the security measures taken to prevent this. In particular, but not exclusively, Panapop cannot take responsibility for the damage caused by a user impersonating a third party or committing identity fraud.

8. RESPONSIBILITY

By participating in the draw, a user expresses full agreement with these terms. 

Panapop reserves the right to modify the draw terms and conditions, partially or in full, at any time. Panapop also reserves the right to cancel a draw, as well as the right not to award a prize, if any anomalies are detected. If any terms are modified, or if the draw is cancelled, this will be communicated by means of a notice on www.panapop.com.

Panapop reserves the right to exclude participants from a draw if they are found to be in violation of any of the terms laid out in this policy. Any abuse or violation of these terms will disqualify the offending party from participation in the draw. A participant who is excluded from a draw loses all rights derived from their former status as a participant. 

Panapop cannot be held liable if any errors are found in the data provided by a participant, rendering them unidentifiable. 

9. LEGISLATION 

These terms are subject to Spanish legislation. Any claims or complaints relating to the draw should be sent to hello@panapop.com. Any conflicts regarding the application or interpretation of these terms will be placed before the relevant authorities, if an amicable agreement cannot be reached by the relevant parties.
